                                ORDINANCE NO. 9791
        
        
                   AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS
                   AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS
                   TO AMEND CERTAIN SECTIONS RELATIVE TO
                   REQUIREMENTS FOR THE HEIGHT OF STRUCTURES IN
                   THE C-1 HIGHWAY COMMERCIAL ZONE, C-2
                   CONVENIENCE COMMERCIAL ZONE, C-4 PLANNED
                   COMMERCE CENTER ZONE AND C-6 COMMERCIAL ZONE.

              	   WHEREAS, there has been some confusion in the
         interpretation of the requirements for the height of structures 

         in the City of Chattanooga Zoning Ordinance relative to the C-4 

         Planned Commerce Center Zone; and
              	   WHEREAS, there are different requirements in the C-1
         Highway Commercial Zone, C-2 Convenience Commercial Zone, and
         C-6 Commercial Zone that would be more appropriately addressed
         with the same height and are requirements as are being proposed 

         for the C-4 Planned Commerce Center Zone;
                                 NOW, THEREFORE,
              	   BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
         CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, 
the
         Zoning Ordinance, be and the same is hereby amended as follows:
              	   SECTION 1.	  That Article V, Sections 509, 609, 811,
         and 928 be deleted in their entirety and the following sections 

         substituted in lieu thereof:
                   (509, 609, 811, 928) Maximum, Height of
                        Structure
                   	No building or structure shall exceed two
                        and one-half stories or 35 feet in
                        height, except that a building or
                        structure may exceed these height
                        requirements provided that for every one
                        (1) foot of additional height over 35
                        feet the building or structures shall be
                        set back one (1) additional foot from all
                        property lines.				
                  
         	   SECTION 2.	  BE IT FURTHER ORDAINED that this
         Ordinance shall take effect two weeks from and after its 
passage
         as required by law.
